Judge guidelines that South Lake Tahoe cannabis microbusiness approvals can move forward

SOUTH LAKE TAHOE, Calif. – A Sacramento Superior Court Judge has narrowed the scope of the short-term injunction filed against the City of South Lake Tahoe, the City Council, and the Improvement Solutions Director Kevin Fabino on November 15.. The judge ruled on Friday, November 22 that his preceding order will not influence microbusinesses, just retail sales, according to South Lake Tahoe City Lawyer Heather Stroud who was in Sacramento for the ruling.

Stroud mentioned the judge created 3 rulings now. He clarified that his ruling final week was not a short-term restraining order as he had not however reviewed the case. He will rule on that December 20. The judge also mentioned the order does not apply to any applicants, only the City, and, that microbusinesses can move forward on acquiring their improvement permits.

Final week, South Lake Tahoe businessman John Runnels and his lawyer Steven Bailey went to Sacramento to get the judge to quit all cannabis companies from moving forward via the permitting approach.

Runnels applied for 1 of the new retail sales licenses that the City was issuing immediately after a new cannabis ordinance was passed. Out of the 18 applicants for retail sales, Runnels placed 18th. The prime 3 had been chosen and two of them, Embarc Tahoe and Cannablue, had currently received approval by the Arranging Commission and had been headed to City Council on December three. Runnels mentioned the approach was flawed and questioned the blind scoring of applications.

“We are hoping for a favorable ruling on December 20,” mentioned Stroud.

When the retail sales approach will not move forward in South Lake Tahoe till the subsequent court hearing on December 20, microbusiness applicant Excellent Union can have its cannabis improvement permit to operate at 2227 James Avenue heard by the City Council on December three, their subsequent meeting.

In preceding action, microbusiness owner Oliver Starr was authorized and permitted and is now functioning with the State to open Redefining Organics at 1090 Industrial Avenue. He will be supplying distribution, extraction and cultivation solutions.
